Finally! Dinagat Islands now a Province! - SC Upheld the Legality of RA 9355

The Supreme Court affirmed the legality of Republic Act 9355 or the law creating Dinagat Islands as a separate province from Surigao del Norte.

In a report made by GMA News Online on Thursday, September 20, 2012:

"The Supreme Court has upheld the legality of Republic Act No. 9355, the law that declared the Dinagat Islands in northeastern Mindanao as a separate province from Surigao del Norte.
In an en banc resolution last September 11, the high court denied a motion for reconsideration filed May 24, 2011 by petitioners former Surigao del Norte politicians Rodolfo Navarro, Victor Bernal and Rene Medina seeking to reinstate a Feb. 10, 2010 ruling declaring RA 9355 as unconstitutional.
The February 2010 decision was overturned on April 12, 2011 when the majority took back their earlier ruling and decided to uphold the legality of Dinagat Islands provincehood.

Critics have since branded the reversal as a "flip-flop," to which then-Supreme Court spokesman Midas Marquez said: "In the greater interest of justice, you can always consider each particular case."
The reversal prompted the petitioners to file the motion for reconsideration last May 24, 2011.

But in its latest ruling on the case, the high court ruled: "The Court Resolved to DENY WITH FINALITY the said motion for reconsideration as no substantial arguments were presented to warrant the reversal of the questioned resolution."

RA 9355
In October 2006, then-President Gloria Macapagal-Arroyo signed into law RA 9355 otherwise known as "An Act Creating the Province of Dinagat Islands." A new set of provincial leaders was later installed as a result of the May 2007 elections.
In November 2006, a month after the Dinagat Islands became a province, Navarro's group filed a petition for certiorari with the Supreme Court, seeking to nullify RA 9355.
The court dismissed both their petition and a motion for reconsideration. The petitioners later filed yet another petition for certiorari which the high court eventually granted on February 10, 2010. Consequently, the ruling not only voided RA 9355 but the election of its officials as well.
The petitioners insisted the Dinagat Islands could not be made into a province because it has not met the requirements set under Section 10, Article X of the Constitution and of Section 461 of the Local Government Code (LGC).
Section 10 reads as follows: "No province, city, municipality, or barangay may be created, divided, merged, abolished, or its boundary substantially altered, except in accordance with the criteria established in the local government code and subject to the approval by a majority of the votes cast in a plebiscite in the political units directly affected."
Under the LGC, an area could be turned into a province provided that it has an average annual income of P20 million and either of the following: It has a "continuous" land area of at least 2,000 square kilometers; and a population of not less than 250,000 people.
The petitioners stressed that Dinagat Islands at the time had a land area of 802.12 square  kilometers and a  population of only 106,951.
The government argued that the Dinagat Islands should be exempt from the LGC requirements since they are composed of several islands and not just one "continuous" territory.
But the high court, in the February 2010 ruling penned by Associate Justice Diosdado Peralta, sided with the petitioners: "The land area requirement shall not apply where the proposed province is composed of one (1) or more islands,” is declared NULL and VOID."
But in a later ruling, the high court pointed out why the exemption from land area requirement only applied to units smaller than a province and not to provinces themselves.
"There appears neither rhyme nor reason why this exemption should apply to cities and municipalities, but not to provinces," the majority said.
The high court said that while the LGC's exemption only covered municipalities and cities, provinces were later included as well as "expressly provided" in Article 9(2) of the LGC's Implimenting Rules and Regulation (LGC-IRR). The high court described the non-inclusion of provinces from the land area requirement exemption as an "inadvertent omission."
"Thus, when the exemption was expressly provided in Article 9(2) of the LGC-IRR, the inclusion was intended to correct the congressional oversight in Section 461 of the LGC – and to reflect the true legislative intent. It would, then, be in order for the Court  to uphold the  validity of Article  9(2) of the LGC-IRR," the court said.
Among the dissenters in the Sept. 11, 2012 ruling were Peralta, Chief Justice Maria Lourdes Sereno, and Associate Justice Antonio Carpio, Arturo Brion, Martin Villarama Jr, and Estela Perlas-Bernabe.
In his dissenting opinion, Carpio said the petitioner's motion for reconsideration should have been granted and that the February 2010 should be reinstated.
"To validate Dinagat Islands’ provincehood, the majority skirts around these minimum statutory requirements by the simple expedient of exempting Dinagat Islands from the minimum land area requirement (while still conceding its non-compliance with the minimum population requirement)," Carpio said.
Carpio said there was a reason why Congress had particularly not given any exemption in the land area requirement in creating provinces.
"Congress intentionally fixed the minimum land area equirement for provinces because provinces host cities and municipalities, which have minimum land area requirements," he said.
"Undoubtedly, the people of Dinagat Islands are entitled to aspire for provincehood. This coveted status, however, with its  concomitant responsibilities and benefits, must be attained in accordance with the law... Currently, the law and the Constitution bar Dinagat Islands from  attaining such status," he added."GMA News Online

2012 COMGUILD Awards: GMA-7 Programs and Personalities Received Awards

COMGUILD Center for Journalism bestowed awards for this year's most prominent news program, anchors and reporters including some programs and personalities from GMA-7's News and Public Affairs team. Among the awardees were 24 Oras as the Best News Program for the 2nd time, Jessica Soho as Most Outstanding News Presenter and  Mel Tiangco as Best Entertainment Talk Show Host for her program in GMA News TV "Powerhouse".

Moreover, Kara David was awarded as Best Female Field Reporter while Jiggy Manicad was the Hall of Famer for Best Male Field Reporter. Miss Marisa Flores, the GMA Senior Vice President for News and Public Affairs was also cited as Best Lecturer and Speaker on the event.

4.9 Magnitude Earthquake Jolts Eastern Samar

A 4.9-magnitude earthquake jolts several parts of eastern Visayas Saturday afternoon, Febryary 24, 2012 the Philippine Institute of Volcanology and Seismology (PHIVOLCS) said.


The Philippine Institute of Volcanology and Seismology (Phivolcs) said the quake was tectonic in origin and was recorded at 3:01 p.m.

In its bulletin, Phivolcs said the epicenter was traced to 40 km northeast of San Julian in Eastern Samar.

Phivolcs said the quake was felt at Intensity III in Oras, Eastern Samar.

It also said no damage or aftershock was expected from the quake.

Meanwhile, the United States Geological Survey measured the quake at magnitude 5.0. It said the epicenter was traced to:

- 65 km north of Guiuan, Samar
- 82 km east-northeast of Tacloban, Leyte
- 125 km east-southeast of Calbayog, Samar
- 605 km east-southeast of Manila.

No casualties or damages were reported as of this posting.

Volcanic Eruption/Tsunami Warning in Eastern Samar - A Hoax, Said PHIVOLCS

Early this evening, February 5, 2012, there is a text message circulating in Eastern Samar and its nearby provinces about a possible underwater volcanic eruption that may cause a tsunami. The message says "NOTICE: 5:00PM FEB. 5 2012 the underwater volcano in Matarinao, Salcedo Eastern Samar will explode. An expected magnitude intensity higher of 12 will be experienced. Municipality that in sea level area are being adviced to evacuate as early as now for the reason of massive earthquake after shock. Everyone is also adviced to go & stay in open space and higher grounds. The message is from PHIVOLCS who is monitoring the underwater volcano right now in Matarinao, Salcedo, Eastern Samar."


The message was quite alarming yet have to confirm form the concerned agency, the Philippine Institute of Volcanology and Seismology (PHIVOLCS). I Google and found out that the said text message is a hoax, fake and not true. Read the full news from the Philippine Information Agency below:

TACLOBAN CITY, Leyte, Feb 5, 2012 (PIA) – The Philippine Institute of Volcanology and Seismology has not issued any warning about volcanic eruption and tsunami occurrence in Eastern Samar, Phivolcs Director Renato Solidom Jr. said.

Solidom made it clear that all official warnings from Phivolcs are coursed through the DRRMCs (disaster risk reduction management councils). “Not true at all. There is no truth that a Phivolcs personnel issued such warning by Phivolcs as all official warnings are coursed through DRRMCs,” Dr. Solidom said.

The Phivolcs chief said that the series of earthquakes beginning the third week of January 2012, the latest significant tremor with magnitude of 5.9  which occurred at 9:09 p.m. of February 4  with epicenters offshore of Eastern Samar and felt in Samar and Leyte islands, are the result of movements of the Philippine Sea Plate moving under the Eastern Philippine Trench.

“These are not caused by volcanic activity,” Dr. Solidom added, saying that there are no underwater volcanoes east of the Samar Island and it is not possible to have volcanoes there.

The pronouncement was elicited when a text message circulated in Eastern Visayas after an earthquake with a magnitude of 5.9 rocked Eastern Samar at 9:09 p.m. of February 4. The hoax, headlined “NOTICE” stated that at " 5:00 p.m. of February 5, the underwater volcano in Matarinao, Salcedo, East Samar will explode with a magnitude intensity of higher than 12 kilometers. It also warned people to evacuate 'as early as now' to open space and higher grounds."

Dr. Solidom said that aftershocks may still happen, although the exact timing cannot be predicted. Most aftershocks are not significant in sizes but stronger ones cannot be discounted, the Phivolcs chief added.

Dr. Solidom called on the public not panic and not to believe in text rumors, more so, spread rumors. He said that the reason why he sent PIA the message is for the Philippine Information Agency to inform the media and the public.

However, Dr. Solidom said that the public should always be reminded that strong earthquakes have happened in the area in the past. Therefore, it is always important that earthquake and tsunami preparedness be conducted by the DRRMCs, local governments, and the public, Dr. Solidom concluded. (PIA 8)

Just recently, 24 Oras also reported about this false information. Confirmed! This was indeed a hoax mail/message doing the  rounds to fool and fear the recipient and the people of Eastern Samar and its nearby provinces.

Again, STOP SENDING if happened to received this form of text message, you are just scaring your friend or love ones if you do.

REPLAY: Renato Corona Impeachment Trial (Day 1)

Supreme Court Chief Justice Renato Corona will be facing an impeachment trial at the Philippine Senate beginning Monday, January 16, 2012, the first ever impeachment for a Supreme Court Chief Justice in the Philippines.


With 188 congressmen signing the impeachment complaint, more than enough than what is required under the Philippine Constitution, the articles of impeachment was transmitted on December 13, 2011 to the Upper Chamber for trial.

Eight violations were cited in the impeachment complaint against Corona. It is now up to the senators whether or not to affirm the findings of their counterparts at the Lower House.

Covered live by most local broadcast networks, the trial is anticipated by many as a showdown between the prosecution panel from the House of Representatives and the powerhouse legal team defending the head magistrate.

During the proceedings, it is expected that the public would encounter some legal gobbledygook as well as see varying actions (serious or funny) by members of the prosecution, defense and even the impeachment court.

Former President Gloria Macapagal Arroyo has unleashed “It's The Economy, Student!”, an article she wrote during her “house recuperation, re-hospitalization and hospital detention from October to December 2011.”


“It’s the economy, student!” was presented to the media by economist Gonzalo Jurado, Arroyo’s economics professor at the University of the Philippines. The former-president-turned-Pampanga-congresswoman holds a doctoral degree from the UP School of Economics.

She is President Benigno Aquino III’s former mentor at the Ateneo de Manila University.

Philippine Azkals Defeated Sri Lanka Brave Reds - Final Score at Fulltime: 4-0; Aggregate 5-1


Despite the rain which started pouring at the Rizal Memorial Football Stadium in Manila at the start of the first half until midway through the second half, Philippine Azkals defeated Sri Lanka Brave Reds today, July 3, 2011 in the First Round, Leg 2 (Game 2), of the 2014 FIFA World Cup qualifier.

Azkals versus Brave Reds game result - final score at Full Time: 4-0; Aggregate 5-1. The Philippine Azkals will play against Kuwait in the next round on July 23 and July 28, 2011.
